Description
Position Purpose The Chief Compliance Officer – CME Clearing is responsible for developing, implementing and administering policies and procedures to ensure that CME Group and CME Clearing complies with the DCO Core Principles set forth in the Commodity Exchange Act and all other laws and regulations applicable to the operation of CME Group clearing services. The CCO is responsible for promoting a culture of compliance within CME Clearing. The CCO will work with CME Clearing Senior Management Team to ensure that CME Clearing achieves consistently high levels of compliance with all relevant laws and regulations as well as industry best practices. The CCO is responsible for developing and implementing policies and procedures ensure compliance with the CEA, to resolve any conflicts of interest, and for establishing procedures for remediating any noncompliance issues. The CCO will coordinate with the Global Chief Compliance Officer of CME Group and other compliance officers and staff.
Principal Accountabilities * Develop and implement, in consultation with the President of CME Clearing, policies and procedures designed to ensure compliance with (i) the CEA Core Principles applicable to DCOs, (ii) applicable CFTC regulations, (iii) requirements applicable to CME Clearing under the Securities Exchange Act or otherwise imposed by the SEC or other agencies with respect to securities clearing, and (iv) any other applicable law or regulation (CME Clearing Compliance Policies) * Work withCME Clearing Senior Management Team to ensure that CMEClearingachieves consistently high levels of compliance withCME ClearingCompliance Policies and industry best practices * Institute and maintain an effective compliance communication program forCME Clearing, including the training for existing and new CME Clearingemployees concerningCME ClearingCompliance Policies; promote a culture of compliance within CME Clearing * Develop an annual compliance work plan designed, among other goals, to review the compliance of the DCO with respect to the Core Principles and CME Clearing Compliance Policies, and to identify potential areas of compliance vulnerability and risk * Prepare regular reports to CME Clearing Senior Management, the Global Chief Compliance Officer of the Company and the Board of Directors or any subcommittee of the Board as appropriate in connection with the Company’s overall compliance program * Ensure that CME Clearing Compliance Policies are effectively designed, maintained and administered so as to ensure compliance with the CEA and all other applicable laws and regulations * Establish policies and procedures toresolve any conflicts of interest that may arisewith respect to CMEClearingorCME Clearingstaff * Establish procedures for the remediation of any noncompliance issues through any (i) compliance office review, (ii) look-back, (iii) internal or external audit finding, (iv) self-reported error or (v) validated complaint * Establish and follow appropriate procedures for the handling, management response, remediation, retesting and closing of noncompliance issues * Prepare and submit an Annual Compliance report. * Ensure proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required * Respond to requests for information from regulatory bodies and enforcement agencies * Maintain a current knowledge of laws and regulations applicable to the DCO and the clearing business, and monitor and evaluate new developments
Qualifications * 10-15 years experience in financial services * 5+ years of experience with designing and maintaining compliance programs in the financial services industry * Prior experience in legal or compliance-specific leadership roles * Clearing and risk management experience strongly preferred * Experience working directly with regulatory agencies (such as CFTC, SEC, NFA, FINRA) * International regulatory and compliance experience (such as FSA, Basel,IOSCO) * Demonstrated leadership skills and ability to interact effectively across all levels of an organization * Well-developed business acumen and business management skills, complemented by strategic expertise and sound business judgment * Proven abilities to influence others and to achieve tangible business results
